% 01.07.2020 The petitioner vide the present petition has sought expeditious disposal of his application filed under Section 156(3) of the Cr.P.C. in CC. No. 14701/2019 pending before the learned Metropolitan Magistrate, Patiala House Court, New Delhi apart from seeking that a senior officer conducts the inquiry/investigation in the present matter. During the course of the proceedings dated 5.6.2020 the application Crl.M.A. No. 7212/2020 filed on behalf of the applicant seeking impleadment of the DCP, EOW, Mandir Marg, New Delhi as a party was considered and allowed, in as much as, it was informed that the complaint of the petitioner had been transferred to the said office.
The EOW is represented today and a status report dated 30.6.2020 under the signatures of Mr.Amar Deep Sehgal, Assistant Commissioner of Police, EOW, New Delhi, has been submitted on behalf of the State which indicates to the effect that the FIR No. 62/20 dated 29.6.2020 under Sections 420/406/120B of the Indian Penal Code, 1860, PS EOW has been registered on the complaint of Kamal Chauhan S/o late Amar Singh and it has also been averred through the said status report that the complaint of Kamal Chauhan has been received with the complaint of the present petitioner Girish Sayal at Police Station Naraina against M/s DSGM Pvt. Limited , DS Multi Marketing, its officials Mr. Mahender Pandya, Mr.Bhargavbhai Pravichandra Pandya, Mrs. Shivani Bhen Bhargav Bhai Pandya, Mr.Harjinder Saini, Mr.Kamra Singh Baghal, Mr.Deepak Mehta and Mr.
Rajesh Dhiman and others and that the complaints were transferred to the EOW and the enquiry has been taken up in the matter and on enquiry it has surfaced that the alleged persons i.e., Mr.Bhargav Pandya Ms.Shivani Pandya, (present directors of M/s DSGM Pvt. Limited) Mr.Mahender Pandya, Mr.Deepak Mehta (North Area Regional Manager) Mr.Harjinder Saini, CEO of M/s DSGM I Pvt. Limited, and others have allegedly collected huge amounts in the accounts of DS Multi Marketing and DSGM India Pvt. Limited and a multi victim case is already registered in Udaipur, Rajasthan where innocent victims have been cheated by the alleged persons/companies.
The status report dated 30.6.2020 which has been submitted through e-mail indicates that the FIR No. 62/20 dated 29.6.2020 under Sections 420/406/120B of the Indian Penal Code PS EOW has been registered on the
complaint of Kamal Chauhan and that the investigation has been taken up by the Investigating Officer of that case who has also investigated in relation to the complaint of the petitioner. Apparently, thus the present petition calls for no action and thus the petitioner seeks to withdraw the present petition with liberty to seek redressal in accordance with law subsequently, if required. The petition is thus dismissed as withdrawn with liberty granted, as prayed.
