1. The petitioner has approached this Court seeking quashing of order dated 22.07.2022 passed by the respondent no.2, vide which his request for getting the circumstances in which he claims he was coerced to seek voluntary retirement as also the humiliation met out to him by his superior officers be investigated by the Central Bureau of Investigation(CBI), has been rejected.

2. After some arguments, learned counsel for the petitioner concedes that the petitioner has till date not assailed his voluntary retirement from service, which he claims was under coercion.

3. In these circumstances, we are of the considered view that unless the petitioner assails his voluntary retirement from service and is able to prima facie show that he was coerced to submit his voluntary The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. retirement, the prayers, as sought by him, cannot even be considered.

4. When faced with this situation, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to the petitioner to assail the order of voluntary retirement and seek appropriate directions for investigation by the CBI, in case, he succeeds in his challenge to the order of his voluntary retirement from service.

5. In the light of the aforesaid, the petition along with pending applications stands dismissed as not pressed with liberty as prayed for.

6. Needless to state, this Court has not expressed any opinion on the merits of the petitioner's claim that he was coerced to tender voluntary retirement or that he was humiliated by his superior officers.
