CRL.M.A. 11342/2026 (seeking permission to deposit expenditure for the surgery) 3.
By way of the present application, the learned counsel appearing on behalf of the petitioner seeks permission of this Court to deposit expenditure for surgery and other ancillary expenses directly with the All India Institute of Medical Sciences (hereafter 'AIIMS') and allow one family member to remain present at the hospital during the surgery and post-operative care. 4.
Vide order dated 02.04.2026, this Court had passed the following order:
"...4. Considering the medical condition of the petitioner, the Medical The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Superintendent, AIIMS is directed to pre-pone the date for medical treatment of the petitioner herein.
5. The Jail Superintendent, Tihar, New Delhi is directed to ensure that the petitioner is taken to the hospital on 09.04.2026 for appropriate medical treatment.
6. In case, any emergent surgery is required, let a date be fixed by the concerned doctor, under intimation to this Court.
7. In view of above terms, the present petition stands disposed of..." 5.
The learned counsel appearing on behalf of the petitioner apprehends that, in case the expenditure amount is not deposited by the Superintendent, Tihar Jail, the surgery will be postponed by the AIIMS hospital. 6.
The learned ASC for the State, however, has placed on record a reply filed on behalf of Senior Medical Officer-Incharge, Jail Dispensary, Central Jail No.1, Tihar, New Delhi, wherein it is not so mentioned. 7.
Further, the learned ASC for the State informs the Court that it is the responsibility of the Jail Authorities to deposit the expenditure amount for conducting any medical procedure or tests of the inmate; however, they were unable to point out any rule in this regard. 8.
This Court without going into this issue at this stage, since the surgery of the petitioner herein is fixed for 17.04.2026 and the Medical Superintendent, AIIMS Hospital has already mentioned in Annexure A-2 that financial arrangement is to be made for investigation charges and purchase of medicines required at the time of treatment/admission, this Court permits the family of the petitioner to directly deposit amount if any, required to be deposited with the concerned hospital authorities, so that the surgery is not postponed.

Further, one family member namely, Paramjeet Kaur, mother of the petitioner will be permitted to be present at the time of surgery and to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
