% 27.02.2019 Pro-active role has been attributed to the petitioner in FIR no.29/2019 registered by police station Laxmi Nagar respecting an incident that occurred on 01.02.2019, involving offences punishable under Sections 308, 452, 323, 34 IPC.

Though it appears that the petitioner and the opposite party, do have a history of dispute over property, the petitioner has criminal antecedents in that he was involved in similar offences in case FIR no.126/2007 of police station Shakar Pur, wherein after sessions trial in case FIR no.101/2010, he was held guilty and convicted on the charge for offences under Sections 323/ 34 IPC, his appeal being presently pending. His brother, Naveen, is also a co-accused in the present FIR. It is pointed BAIL APPLN. 522/2019

out that even after the incident of 01.02.2019, the said Naveen having been released on bail, made another attempt on 11.02.2019 at assault on the kin of the complainant of the present case, this being subject matter of FIR no.35/2019 involving offences under Sections 323, 341, 506, 34 IPC.

With this background, it is not a case for admitting the petitioner to anticipatory bail. It is necessary that he appears before the investigating agency and joins the investigation.
