The present petition has been filed by the persons claiming to be street vendors (13 in number) as well as an association (petitioner no.1) inter alia praying that the petitioners be allowed to vend at the vending site in City SP Zone, Ward-N-85, Chandni Chowk, Delhi 110006 without any hinderance by the public officials. The petitioners above have been issued Certificate of Vending (COV) indicating their area of vending as "City SP Zone, Ward-N-85". Concededly, the said petitioners have not been allocated any site or a fixed place to carry on their vending activities. Thus, in accordance with the terms and conditions as applicable to the COV, the petitioners are proscribed from vending at a fixed place for more than thirty minutes or such time as may be fixed by the Town Vending Committee (TVC).

Learned counsel appearing for the petitioners submits that the petitioners shall carry on their vending activities in accordance with the terms and conditions of their COVs.

Learned counsel appearing for the MCD submits that the MCD has no objection if the petitioners carry on their vending activities in terms of their respective COVs.

In view of the above, the present petition is allowed by restraining the respondents from interfering with the vending activities carried out by the petitioners provided that the same are in accordance with the law and in terms of their respective COVs.
