1. Upon mentioning, this writ petition is taken up on board.

2. The Court has today while hearing writ petition being W.P.(C) No.2629 and 2703 of 2019 filed by Shrey Aeren and Sanjeev J. Aeren had permitted the Petitioners therein to withdraw their respective writ petitions with liberty to pursue the points raised therein before the CIT(A), before whom the statutory appeals were pending.

3. In the course of that hearing, the learned counsel for the Petitioners, who is the same in this case as well, had drawn the attention of the Court to the order passed by this Court on 27th February, 2019 in the present writ petition, directing notice to issue to the Respondents. In the present writ

petition too, a challenge has been raised directly to the assessment order against which a statutory remedy of an appeal is available.

4. Accordingly, this Court is not inclined to entertain even this petition. This petition is dismissed as withdrawn while granting liberty to the Petitioner to urge all the points urged in the present writ petition in the statutory appeal before the CIT (A).

5. The petition is disposed of in above terms. No costs.

6. The next date of 15th July, 2019, already fixed in the matter, stands cancelled.
