O R D E R

% 17.02.2020 This petition seeks directions to the respondent to make a reference to the appropriate Labour Court/Industrial Tribunal. The grievance of the petitioner not finding any worthwhile resolution, albeit, despite the Failure of Conciliation Report (FOC) by the Assistant Labour Commissioner addressed to the Ministry of Labour and Employment, Government of India. Subsequent to the petitioner's representation in terms of the failure of the FOC, the aforesaid Ministry has written to the Assistant Labour Commissioner, GNCTD, vide letter dated 23.09.2019 that they had not received any such FOC. Obviously, in the absence of the same, the Ministry would be constrained from making a reference.

In view of the above, respondent is directed to respond to the letter of the Ministry of Labour and Employment, Government of India, within a period of two weeks from today so that the latter is able to take appropriate

action in the matter.

The petition is disposed-off in the above terms. A copy of this order be given dasti under the signature of the Court Master to the learned counsel for the parties. NAJMI WAZIRI, J FEBRUARY 17, 2020 kb
