Settlement Agreement dated 04th May, 2026 is before this Court. The said Agreement has been negotiated through the process of mediation in the Delhi High Court Mediation and Conciliation Centre. 2.

The present suit has been filed seeking relief of partition, declaration, mesne profits, rendition of accounts and permanent injunction in respect of the suit property bearing no. 137, Tarun Enclave, Pitampura, Delhi-110034, and also challenging the Relinquishment Deed dated 28th August, 1996. 3.

The parties herein were referred to mediation vide order dated 01st April, 2026, and subsequently, the Settlement Agreement dated 04th May, 2026 has been entered into between the parties. In terms of the settlement arrived at between the parties, defendant nos. 1 and 2 were to pay a sum of Rs. 51,70,000/- (Rupees Fifty One Lakhs Seventy Thousand only) to the plaintiff.

A demand draft of the aforesaid amount has been handed over by learned counsel appearing for defendant nos. 1 and 2 to the learned counsel appearing for the plaintiff in the presence of the Court, who has handed over the same to the plaintiff.

Copy of the said demand draft is taken on record. 7.

Considering the Settlement Agreement entered into between the parties, learned counsel appearing for the plaintiff submits that he has instructions to withdraw the present suit.

The parties shall abide by the terms of the Settlement Agreement and shall raise no claims against each other with respect to the issues, which have been settled by way of the Settlement Agreement. 9.

Accordingly, the present suit is dismissed as withdrawn. 10.
