The learned counsel for the applicant submits that the bail application filed by the applicant before the learned Trial Court was dismissed for the reasons that the eye witnesses were not examined. He submits that the eye witnesses have now been examined, and have not supported the case of the prosecution. 2.
The learned Additional Public Prosecutor for the State submits that the brother of the victim who had recorded the dying declaration, is a material witness and he has apprehension that the said witness would be threatened if bail is granted to the applicant.

The learned counsel for the applicant seeks liberty to withdraw the present bail application, with a liberty to file it afresh after the examination of the brother of the victim is completed.

The bail application stands dismissed as withdrawn with the aforesaid liberty.
