The Petitioner is seeking initiation of the contempt proceedings against the Respondents for the alleged wilful defiance contained in the Order dated 24.12.2024 in W.P. Learned counsels for the Respondents are present on advance notice.

It is submitted by the learned counsel for respondent no. 2/ Special Task Force ['STF'] that the matter is under examination with the STF.

Insofar as, learned counsel for respondent No.1/MCD is concerned, it is stated that the building is constructed on the plot measuring 75 sq. yards pursuant to a sanctioned plan and on the directions passed by this Court, the site was inspected and certain deviations have been informed. It is stated that the Show Cause Notice dated 09.03.2015 has already been issued to the occupier of the premises, and the MCD is taking appropriate action in accordance with the law.

Accordingly, nothing survives in the present contempt petition. Moreover, it appears that the Petitioner has no locus-standi as he is residing far away from the place in question. Nothing is explained in the present contempt petition as to how is the Petitioner affected by any action or inaction on the part of the Respondents. Hence, the present petition is dismissed. However, the Respondents shall proceed in accordance with the law.
