% 27.02.2019 The petitioner seeks bail. He has been accused of repeatedly sexually assaulting a minor of 6 years; the medical report shows a tear in her private part albeit old; her statement under section 164 Cr.P.C. accusses the petitioner of the offence.

According to the learned Counsel for the State, the petitioner being a relative of the minor, has misused his proximity with the victim; that his being released on bail, at this stage, is likely to cause an apprehension in the minds of the victim and her family and otherwise come in the way of further proceedings.

The allegations are serious. In the circumstances, no case is made out for grant of bail.

The petition, alongwith pending application, is dismissed. NAJMI WAZIRI, J.
