O R D E R
% 18.05.2026 By way of the present petition filed under sections 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks interim bail for a period of 30 days in case FIR No. 521/2021 dated 08.06.2021 registered under sections 302/397/34 of the Indian Penal Code, 1860 and sections 25/27/54/59 of the Arms Act, 1959 at P.S.: Punjabi Bagh, West Delhi inter alia on the ground that he needs to arrange for payment of outstanding rent for the rented premises where his wife and minor child are residing.

Notice on this petition was issued vidé order dated 27.04.2026, pursuant whereto Status Report dated 05.05.2026 has been filed in the matter.

Nominal Roll dated 07.05.2026 has been received from the concerned Jail Superintendent.

Mr. Deepanshu Goswami, learned counsel appearing for the petitioner submits, that as verified in the status report, the petitioner's wife is presently residing in a rented premises in Loni, Ghaziabad, Uttar The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Pradesh and that a legal notice regarding non-payment of rent has been issued by the landlord's wife to the petitioner's wife. Mr. Goswami submits, that the petitioner's personal presence is required in order for him to arrange money to pay the rent. 5.
On the other hand, Mr. Shubhi Gupta, learned APP appearing for the State submits, that though it has been verified that the rent of the house where the petitioner's wife resides has not been paid, but the issue is purely financial in nature and does not require the physical presence of the petitioner.

Mr. Gupta points-out, that the petitioner is a repeat offender and has 02 other cases pending against him.

It is noticed however, that of the 02 other cases pending against him, the petitioner is on bail in one of them; and that his overall jail conduct is stated to be 'satisfactory'.

Upon an overall conspectus of the matter, and considering the ground on which interim bail is sought, the petition is allowed. 9.
The petitioner - Rizwan s/o Hakimuddin - is granted interim bail for a period of 02 weeks from the date of his release, subject to the following conditions:
9.1.
The petitioner shall furnish a personal bond in the sum of Rs. 15,000/- (Rs. Fifteen Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the Jail Superintendent;
9.2.
The petitioner shall not leave the territory of the National Capital Region without prior permission of this court and shall ordinarily reside at the address as per prison records; The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
9.3.
The petitioner shall furnish to the Investigating Officer/S.H.O P.S.: Punjabi Bagh a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;
9.4.
If the petitioner has a passport, he shall surrender the same to the Jail Superintendent and shall not travel out of the country without prior permission of this court;
9.5.
The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial; and 9.6.
Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.

A copy of the order be sent to Jail Superintendent for information and compliance forthwith.

Petition stands disposed-of in the above terms. 12.
