JUDGMENT

BRIJESH SETHI, J (oral) The petitioners have filed the present petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No. 0009/2020, under Sections 308/323/506/34 of the Indian Penal Code, 1860, registered at P.S.: Jamia Nagar and the proceedings emanating therefrom.

Learned counsel for Mr. Avi Singh, Additional Standing Counsel (Criminal) for the State submits that the petitioners and respondent nos.2 W.P.(Crl.) 469/2020

to 4 are neighbours. A dispute over a trivial issue led to the registration of the aforementioned FIR against the petitioners. The Investigating Officer, who is present in the Court, has identified the petitioners as well as respondent nos.2 to 4. The petitioners and respondent nos.2 to 4 have submitted that they have settled their disputes amicably vide Memorandum of Understanding dated 4th February, 2020.

Respondent nos.2 to 4 reiterated the aforesaid facts and submitted that they have amicably settled their dispute without any pressure or coercion from any source whatsoever. Respondent nos.2 to 4 have further submitted that they have no objection if the FIR is quashed and the petition is allowed.

In view of the above facts, no fruitful purpose would be served in keeping the parties entangled in criminal proceedings. Accordingly, in the interest of justice, FIR No. 0009/2020, under Sections 308/323/506/34 of the IPC, registered at P.S.: Jamia Nagar and the proceedings emanating therefrom are quashed.

The petition alongwith pending application is disposed of accordingly.
