The present petition has been filed under Article 227 of the Constitution of India for seeking appropriate directions to the learned ARC, West District, Tis Hazari Court, New Delhi (hereinafter referred as 'ARC') in RC ARC No. 44/2020 to decide the application seeking leave to defend in a time bound manner.

Learned counsel submits that the petitioner herein is 71 years old and had filed an eviction petition under Section 14(1)(e) of the DRC Act, 1958 in the year 2020. defend on 17.09.2020 and since then the same has not been disposed of. 5.
On last few occasions, the arguments could not be addressed on the application seeking leave to defend as adjournments were requested on behalf of the respondents, however, ultimately the arguments were heard on 14.10.2023 and since then the orders have not been pronounced on the application.

It is further submitted that in the meanwhile, the written submissions have been placed on record by the parties and the matter was listed on 27.01.2024 for procuring of the order which has now been adjourned to 04.04.2024. It is thus submitted that directions for expeditious disposal of the application seeking leave to defend be passed. 7.
Having considered the submissions and the record made available before this Court, learned ARC is directed to dispose of the aforesaid application seeking leave to defend expeditiously preferably on the next date fixed before it.
