% 01.12.2016 CM No. 32413/2016 (for revival of petition) in W.P.(C) 702/2011 This application filed by the applicant, a guarantor is for revival of the writ petition filed by the borrower, which was disposed of by an order dated 08.05.2014.
The applicant not being the writ petitioner in the writ petition, this application for revival of the writ petition is misconceived. There can be no question of revival of a writ petition at the instance of any person other than the writ petitioner. The application is thus dismissed. However, the dismissal of this application will not prevent the applicants/legal representatives of the respondent No. 2 in the writ petition from repaying the dues of the bank and freeing the third property being 1192/XIII of Sh. Vinod Kumar.
