In furtherance of last order, IO/Inspector Uttam Kumar has submitted a certificate issued by the doctor at Max Hospital which is accepted across the board to be scanned and made part of the file. According to the said certificate, till 05:10 pm wife of the applicant was not brought in the hospital and further it mentions that if she was brought subsequently, the surgery would have to be postponed.

Further, the IO states that he received a WhatsApp message at 09:29 am from the concerned doctor: "Good Morning Sir I'm discharging the Patient Mrs Farheen as she's not the one who met me in OPD". IO is directed to place on record printout of screenshot of that message and the SHO concerned (PS Saket) shall register FIR and investigate the case. 3.
Even at this stage, learned counsel for applicant tried to insist that wife of accused is admitted in the hospital. On being asked as to who had instructed him regarding this, after a bit reluctance, learned counsel stated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. that it is the brother-in-law of applicant who informed him. 4.
However, in view of above circumstances, learned counsel for applicant seeks permission to withdraw this bail application. 5.
The application is dismissed as withdrawn.
