Learned counsel for the parties state that pursuant to the order whereby the parties were referred to the Delhi High Court Mediation and Conciliation Centre, they have arrived at a settlement as recorded in the Settlement Agreement dated 17.10.2019, whereunder the respondent has agreed to pay to the appellant a sum of Rs.8.70 lacs, in full and final settlement of all the claims raised by the appellant against him.

Learned counsel for the parties jointly state that the respondent has already paid the first instalment of Rs.2 lacs to the appellant in January, 2020. The second instalment of Rs.2 lacs by way of a demand draft dated 04.02.2020 bearing No.102841 drawn on Canara Bank, Subroto Park Branch, Delhi, is handed over to the counsel for the appellant today. The remaining terms and conditions have been set out in para 12 (b) to (h) of the Settlement MAT.APP.(F.C.) 62/2019
Agreement dated 17.10.2019. Both the parties have agreed that they shall abide by the terms and conditions of the Settlement and request that the present appeal may be disposed of in terms of the Settlement Agreement dated 17.10.2019.

We have perused the Settlement Agreement. The same has been signed by both the parties, counsel for the parties and the learned Mediator. In view of the fact that the parties have arrived at the aforesaid settlement of their own free will, volition and without any undue force and coercion, the same is taken on record. The parties shall remain bound by the terms and conditions of the Settlement.

The appeal is disposed of in terms of the Settlement along with the pending application.
