CRL.REV.P. 148/2020 & CRL.M.A.3566/2020 (for stay) The present criminal revision petition has been filed by petitioner under Section 397 read with Section 401 of the Cr.P.C. against the order dated 29.11.2019 in CC No. 616037/2016 passed by Metropolitan Magistrate, Saket, New Delhi in the application filed by petitioner/accused seeking directions for sending the dishonored cheque and receipt to CFSL for comparing the signatures.

It is not in dispute that there are two conflicting reports of respective private experts regarding the signatures on the receipts. However, admitted fact is that signatures on the cheque have not been disputed.

In view of above, I am of the view that Trial Court shall take steps to send the dishonored cheque and receipt to CFSL for comparison of the signatures within one week from the date of receipt of this order. Application is, accordingly, allowed and disposed of. Pending application also stands disposed of.
