After some arguments, the counsel for the plaintiff states that IA No.5213/1999 of the defendant no.1 Heavy Engineering Corporation Ltd. under Section 8 of Arbitration and Conciliation Act, 1996 for referring the parties to arbitration be allowed and the suit be disposed of in terms thereof. 3.

The counsel for the defendant no.1 Heavy Engineering Corporation Ltd. and the counsel for defendant no.2 M/s Northern Coal Fields Ltd. have nothing to say.

IA No.5213/1999 is allowed and the suit is disposed of by referring the parties to arbitration.

No costs.
