Learned APP accepts notice on behalf of the State. 3.

By this petition, the petitioner seeks anticipatory bail in case FIR No. 240/2017 under Sections 448/380/506/34 IPC registered at PS Vasant Kunj, South.

The petitioner had earlier approached this Court seeking anticipatory bail by way of Bail Appl. No. 1551/2017 which was dismissed as withdrawn on 4th August, 2017.

Learned counsel for the petitioner urges that the change in circumstances now is that two co-accused have been granted bail, thus the petitioner is also entitled to bail.

Learned APP for the State clarifies that one other co-accused Rajiv Sherawat has been granted regular bail by this Court vide order dated 9th January, 2018. Thus even the co-accused has not been granted anticipatory bail but regular bail.

Considering that there is no change in the circumstance, this Court finds no ground to entertain the second application for grant of anticipatory bail.

Application is dismissed.
