Mr. Rajesh Kumar, Advocate versus GOVT OF NCT OF DELHI ..... Respondent Through:
Mr. Amit Chaddha, APP with SI Ompal Singh, PS:Bhalswa Dairy, Delhi
CORAM:
HON'BLE MR. JUSTICE CHANDER SHEKHAR
O R D E R
% 29.08.2019 1.
This is an application filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail.
2.
The brief facts of the case are that an FIR was registered on the statement of Gopal and Tarun, father and brother respectively of the deceased, Mamta, wherein the complainant alleged that the petitioner married the deceased on 21.2.2016 and he used to quarrel with her after marriage on monetary matters/dowry demand. The deceased Mamta & accused Rahul were married for almost eight months. Deceased Mamta committed suicide by burning herself on 8.10.2016. 3.
Learned APP submitted that, earlier three bail applications of the petitioner were dismissed and there has been no change in circumstances. Learned counsel for the petitioner admitted that three bail applications of the petitioner were dismissed earlier and he is not able to point out any change in
circumstances.
The fact that the complainant has specifically levelled allegations against the petitioner; the trial is at the fag end and only the Investigating Officer is to be examined as well as taking into consideration the gravity, nature of accusation, the severity of punishment in case of conviction, the nature of supporting evidence and the larger interest of public and the State, I do not find any merit in the present bail application and the same is, accordingly, dismissed.
