The present Criminal Leave Petition under Section 378(4) Cr.P.C. read with Section 482 Cr.P.C. has been filed by the Petitioner seeking leave to appeal against the Order dated 31.01.2019 passed by the learned Metropolitan Magistrate in CC No. 513649/2016, whereby the Respondent has been held not guilty and acquitted of the offence under Section 138 Negotiable Instrument Act.

For the reasons stated, the Petition is allowed. Appeal be registered. 3.

The Petition is accordingly disposed of.
