% 17.02.2020 At the outset, learned counsel for respondent No.1/SDMC submits that the impugned order dated 14.01.2020 passed under section 345-A of the Delhi Municipal Corporation Act, 1957(hereinafter referred to as the 'DMC Act') is an appealable order before the learned ATMCD under section 347B of the DMC Act.

In view of the said submission of the learned counsel for respondent No.1/SDMC, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to challenge the impugned order before the learned ATMCD. Granting leave and liberty as sought for present petition is dismissed as withdrawn. All pending applications, if any, are also dismissed as withdrawn.
