The present petition has been filed under Article 226/227 of the Constitution of India seeking issuance of writ in the nature of Certiorari, assailing the Order dated 13.01.2020 passed by the learned Debts Recovery Appellate Tribunal, Delhi (DRAT) in Regular Appeal No. 187/2019 filed by the Petitioner/Bank, whereby, the appeal has been rejected and a cost of Rs. 5 lakhs has been imposed on the petitioner.

Heard learned counsel for the parties.

Learned counsel for the parties agree that let the bank proceed with the auction as per the rules without any conditions being imposed as are provided by the Order of the Debts Recovery Tribunal-II, Delhi (DRT) dated 28.03.2019, provided that the respondents shall also have a right to bring bidder to participate in the said auction.

In view of the foregoing, the costs to be borne by the petitioner as per the Order of the DRAT dated 13.01.2020, is reduced from Rs. 5 lakhs to Rs. 3 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
