% 31.07.2025 CS(OS) 154/2025 and I.A. 18349/2025 (u/O XXIII Rule 3, CPC) 1.

This application has been filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 seeking the recording of compromise arrived at between the parties. The Application is duly supported by affidavits of the authorised representative of the plaintiffs and of the defendant. 2.

It is stated that the parties have settled their disputes in the mediation proceedings conducted before Hon'ble Mr. Justice Jayant Nath, Former Judge of this Court.

The parties have entered into a Settlement Agreement dated 4th June, 2025, which has been duly signed by the authorised representatives of the parties. The terms of the agreement are stated to be confidential in nature. 4.

In view of the aforesaid settlement, the plaintiff seeks to withdraw the present suit.

The suit is dismissed as withdrawn.

The date of 4th August, 2025 before the Joint Registrar stands cancelled.

I.A. 18271/2025 (under Section 16 of the Court Fees Act, 1870) 7.

The present application has been filed on behalf of the plaintiffs seeking a refund of the Court Fees.

Since the matter has been settled in mediation proceedings, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff no.2/Bry-Air (Asia) Pvt. Ltd in terms of Section 16 of the Court Fees Act, 1870 read with Section 89 of the Code of Civil Procedure, 1908.

The application stands disposed of.
