O R D E R

% 29.05.2018 Learned counsel for the petitioner apologizes that Rahat Sharma did not appear before the designated officer on 11.04.2018 at 11.30 A.M. He states that Rahat Sharma is ready and willing to appear before the designated officer for recording of his statement under Section 108 of the Customs Act, 1962.

Learned counsel for the Directorate of Revenue Intelligence(DRI) states that presence of Rahat Sharma is not required as show cause notice has already been issued.

Learned counsel for the petitioner accepts that the show cause notice has been received but states that relied upon documents have not been received. Learned counsel for the DRI disputes the said contention and states that the relied upon documents were sent by speed post on 15.05.2018 and received on 17.05.2018. Learned counsel for the DRI, however, on instructions, states that he would furnish another set of documents in a soft copy(compact disk) within a period of seven days.

Learned counsel for the petitioner seeks liberty to withdraw the present writ petition, in view of the subsequent developments, with liberty to challenge the seizure memo in accordance with law. The writ petition is dismissed as withdrawn, with liberty as prayed for, without commenting on merits. Pending application is also dismissed as withdrawn. No order as to costs.
