Petitioner is defending a suit which is commercial in nature and is aggrieved by order dated 21.12.2022 whereby his written statement was refused to be taken on record and his defence was struck off. 2.

However, learned counsel for petitioner submits that learned Commercial Court has also passed a decree against him on 28.09.2024 and, therefore, present petition has become infructuous. He submits that as and when defendant challenges the said judgment and decree, it would also challenge the order which is impugned before this Court. 3.

Present petition is accordingly disposed of as having become infructuous in aforesaid terms.
