It is noted that the present petition was listed on 27.05.2019 but was deferred since none had appeared for the petitioner and the learned counsel appearing for the respondent had also requested for an adjournment. 2.

Today, none have appeared for the parties on the first call. None appears for the respondent on the second call as well. 3.

The petitioner has filed the present petition, inter alia, praying that the divorce petition bearing no. HMA No. 350/2018, captioned 'Siddharth v. Indu Bala', be transferred from the Court of learned Principal Judge, Family Courts, Rohini Courts, Delhi to the learned Family Court South District, Saket Court, New Delhi.

The petitioner states that she has filed a complaint under Section 12 of Domestic Violence Act, 2005 which is pending before the concerned court at Saket (South District). She states that she is currently employed in

Gurgaon and it is extremely difficult for her to attend to the case instituted by the respondent before the Family Court, Rohini. In this context, she prays that the divorce petition instituted by the respondent be transferred to the concerned court (south district) in order to enable her to effectively defend the said case.

Given the mitigating circumstances as indicated by the petitioner in the present case, this Court considers it apposite to allow the present petition. The divorce petition bearing no. HMA No. 350/2018, captioned 'Siddharth v. Indu Bala', is directed to be transferred from the Court of the learned Principal Judge, Family Courts, Rohini Courts, Delhi to the learned Family Court, South District, Saket Court, New Delhi. 6.

The parties are directed to appear before the concerned court on 14.08.2019.

The petition is disposed of.
