The instant petition is filed seeking following reliefs: "a. Issue an appropriate Writ setting aside the Impugned Order dated 23.12.2021, issued by Respondent No. 1, as being violative of Petitioner's fundamental rights under Articles 14, 19(1)(g) and 21 of the Constitution and Section 30 of the Architects Act, 1972; b. Issue an appropriate writ directing Respondent No. 1 to admit the Claim made by the Petitioner vide his Application dated 06.10.2020, and release an amount of INR 19,98,985/- in favour of the Petitioner. c. Issue a writ of Mandamus directing Respondent No. 3 to ensure strict compliance by Stock Exchanges with the SEBI (Investor Protection and Education Fund) Regulations, 2009 d. Pass any other orders/directions deemed fit and proper in the facts and circumstances of the case."

Learned counsel appearing on behalf of the petitioner fairly concedes that there is an alternate remedy under Section 23L of the Securities Contracts (Regulation) Act 1956, (SCRA), therefore, he may be granted liberty to file the appeal.

With the said liberty, he seeks to withdraw the instant writ petition. 4.

Accordingly, the present petition is dismissed as withdrawn with liberty to file under Section 23L of the SCRA. 5.

Learned counsel, however, submits that by this time the limitation has expired to file appeal under Section 23L of the SCRA. 6.

The Court thus, grants him liberty to file an appeal within a period of 15 days from today along with an application seeking condonation of delay. If such an application is filed, let the same be considered sympathetically keeping in mind the fact that the matter remains pending before the Court since 2023. The similar order seems to have been passed by the Court in W.P.(C) 6682/2023.

All rights and contentions of the parties are left open. Let the appeal be decided with due expedition in accordance with law.
