% 26.02.2016 The present application under Section 438 Cr.P.C. has been filed by the petitioner for the grant of anticipatory bail in FIR No.477/2015, under Sections 406/498A/34 IPC, Police Station Moti Nagar.

The admitted position is that on the application of the applicant/ petitioner, vide order dated 07.08.2015 the learned Additional Sessions Judge directed the Investigating Officer to issue seven days prior notice to the applicants in case of their arrest. Admittedly, no

notice has been issued by the investigating officer till the date and order dated 07.08.2015 is still operative.
