BAIL APPLN. 480/2020 This is an application filed under Section 438 Cr.P.C. on behalf of the petitioner for grant of anticipatory bail in case FIR no. 293/2019, under Section 336 IPC & 25/27 Arms Act, PS Bawana.

Ld. Counsel for the petitioners has prayed for anticipatory bail on the ground that the petitioner is innocent and has been falsely implicated. Petitioner is a young boy and has just completed his 12th class. It is further submitted that the petitioner has not been named in the FIR. The anticipatory bail application is opposed by the Ld. APP for the State on the ground that two shots were fired by unidentified assailants who

were riding on a motor cycle. It is further submitted that sketch of the petitioner was prepared and on the basis of the same, petitioner was apprehended and interrogated.

I have considered the rival submissions. The empty cartridges have already been recovered and custodial interrogation of the petitioner is not required. Accordingly, the anticipatory bail application of the petitioner is allowed. In the event of arrest, the petitioner be released on bail on his furnishing P/B in the sum of Rs. 10,000/- with one surety in the like amount subject to the satisfaction of IO/SHO concerned.
