% 14.03.2019 It has been submitted by the learned counsel Mr. Deepak Kohli for the respondent no.1 that he would file his vakalatnama during the course of the day, which be filed accordingly and submits that no further construction is being raised nor will be raised by the respondent no.1 at the terrace of the suit property. In view of the said submission made on behalf of the respondent no.1, there is no cause for any further action in the matter. The petition is disposed of, in as much as the learned Trial Court of the learned Senior Civil Judge, South is already seized of the application under Order XXXIX Rule 2 A of the CPC. The respondent no.1 shall be bound by the submission made by his counsel.
