BAIL APPLN. 930/2024 1.

An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C') has been preferred on behalf of the petitioner for grant of interim bail in FIR 01/2021 under Sections 21, 25 & 29 NDPS Act registered at PS: Crime Branch on the ground of death of his son on 07.03.2024.

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

Learned counsel for the petitioner submits that son of the petitioner had expired on 07.03.2024 but the interim application has been disposed of BAIL APPLN. 930/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. by learned trial court as being not maintainable vide order dated 11.03.2024 on account of pendency of bail application before this Court. 4.

Since the factum of death of the son of the petitioner already stands verified by the police as per reply filed before learned trial court, petitioner is admitted to bail for a period of six weeks from the date of his release on furnishing a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac only) with one surety in the like amount to the satisfaction of the learned Trial Court and subject to following condition: (i) Petitioner shall provide his mobile number to the Investigating Officer (IO)/SHO concerned at the time of release. 5.

Petitioner shall surrender before the Superintendent Jail after expiry of the bail period. A report in this regard shall be forwarded to learned Trial Court as well as to Registry of this Court by the Superintendent Jail. Application is accordingly disposed of.

A copy of this order be forwarded to the Superintendent Jail and concerned Trial Court for information and compliance.
