Under the facts of the present case and without prejudice, the Court deems it appropriate to refund 50% of the Court fees to the plaintiff. 2.

Ordered accordingly.

However, liberty is reserved in favour of the plaintiff to seek for refund of the remaining 50% of the Court fees, depending upon the decision on the matter, which is listed before the Larger Bench, with respect to refund of the full Court fees.
