This petition has been filed by the petitioner inter alia praying that consequent to his promotion to the rank of Second-in-Command ('2IC') in the Border Security Force ('BSF'), the seniority of the petitioner be fixed just above that of Sh. Rajiv Kumar Bhardwaj. 2.
The learned counsel for the petitioner submits that by an Order dated 07.02.2024 issued by the Commandant (Rectt/Pers), sanction of the Competent Authority has been conveyed to the petitioner, thereby, notionally promoting him to the post of 2IC with effect from 21.10.2016 and also maintaining his seniority in the list just above the name of Sh. Rajiv Kumar Bhardwaj, 2IC, IRLA No. 10077719. He submits that therefore, the major grievance of the petitioner stands satisfied.

He submits that the only grievance of the petitioner that survives is that the Letter dated 07.02.2024 does not mention about The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the grant of consequential benefits to the petitioner. 4.
Needless to state that once the petitioner has been granted notional promotion to the rank of 2IC with effect from 21.10.2016 and his seniority has also been fixed above Sh. Rajiv Kumar Bhardwaj, the consequential benefits have to flow to the petitioner. 5.
The petition is, accordingly, disposed of in the above terms. CM APPL. 6530/2020 6.
