BAIL APPLN. 163/2018 1.

The petitioner seeks anticipatory bail in FIR No. 197 of 2017 under Section 420/120B/34 of the IPC Police Station Crime Branch, Chanakyapuri, New Delhi.

Learned counsel for the petitioner submits that the petitioner as well as other co-accused have settled with the complainant and based on the settlement, the co-accused has been given protection of anticipatory bail vide order dated 17.01.2018 by the trial court. Learned counsel submits that the said settlement and the order was passed after the application of bail was rejected qua the petitioner and BAIL APPLN. 163/2018

as such petitioner has approached this Court. 3.

Learned counsel for the complainant acknowledges the settlement arrived at between the parties and submits that part payment under the settlement has been received. He submits that subject to the petitioner's complying with the terms of settlement he has no objection of the petitioner being released on anticipatory bail. 4.

In view of the above, the petition is allowed. In the event of his arrest, the petitioner, shall be released on bail by the arresting officer/IO/SHO on his furnishing a personal bond in the sum of Rs. 30,000/- with one surety of the like amount to the satisfaction of the concerned Investigating Officer/SHO. The petition is accordingly disposed of.
