The present petition under Section 482 of the Cr.P.C. read with Article 227 of the Constitution of India seeks the following prayers: "a. quash Kalandra u/s 107/111 CrPC and resultant criminal proceedings qua petitioners in the Case arising out of DD No: 70A dated 06.01.2024 u/s 107/150 CrPC PS: Laxmi Nagar, Delhi , currently pending in the Court of Sh. Kusum Pal Malik, Special Executive Magistrate, East Distt., P.S. Shakarpur Complex, Delhi-92. b. Pass any other and / or further order(s) in favour of the Petitioners, which this Hon‟ble Court may deem fit and proper in the interest of Justice and fair play."

Learned counsel appearing on behalf of the petitioners submits that the aforesaid kalandra was registered on account of matrimonial dispute The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. between petitioner no. 3 and his wife Ms. Sapna Rani. It is pointed out that vide judgment dated 23.02.2024 passed by Hon‟ble Division Bench of this Court in W.P.(CRL) 639/2024, the matter has been settled between petitioner no. 3 and his wife.

Learned APP for the State, on instructions of the Investigation Officer, confirms the aforesaid position.

The petitioners are present in Court today and Ms. Sapna Rani, wife of petitioner no. 3 appears through video conferencing and she has been duly identified by the Investigating Officer, SI Kavish Rana, P.S. Laxmi Nagar. 5.

Ms. Sapna Rani, wife of petitioner no. 3 submits that she is living with petitioner no. 3 since the judgment dated 23.02.2024 was passed by the Hon‟ble Division Bench of this Court.

In view of the above, the present petition is allowed. Kalandra u/s 107/111 of the Cr.P.C. and resultant criminal proceedings qua petitioners in the Case arising out of DD No: 70A dated 06.01.2024 under Sections 107/150 of the Cr.P.C. registered at P.S. Laxmi Nagar, Delhi, currently pending in the Court of Sh. Kusum Pal Malik, Special Executive Magistrate, East Distt., P.S. Shakarpur Complex, Delhi-92, is hereby quashed. 7.
