The petition is for directions to respondents no. 1 and 2 to release the entire arrears, funds, and other benefits due to deceased Mausam Rani to the petitioner instead of respondent no. 3.

The petitioner is the father of the deceased, Mausam Rani, whereas respondent no. 3 is her husband. At the time of her demise on 16.03.2021, the deceased had been engaged as an Assistant Teacher at Basic Primary School, Masood Pur, Navoda, Block Joya, District Amroha, Uttar Pradesh. 3.

The petitioner claims that on 24.06.2021, he had made a representation dated 24.06.2021 before the concerned authorities for release of the entire terminal claims and other arrears with respect to the deceased. According to the petitioner, during the lifetime of the deceased, there existed matrimonial discord with respondent no. 3. Further, it is alleged that the deceased was subjected to dowry harassment and cruelty by the latter, who has now remarried.

The stand taken by the respondent-departments in their counter affidavit is that vide letter dated 15.04.2023, the petitioner had been directed to furnish certain documents for processing his claims. 6.

Learned counsel for the petitioner opposes the aforesaid submission, and contends that all the requisite documents have been furnished to the concerned authorities. However, it is seen that there is no material on record to establish the said assertion.

The Court, however, finds that in case the petitioner complies with the necessary requirements as stipulated in communication dated 15.04.2023, the respondents are under an obligation to act upon the same and to do the needful in accordance with law. However, for any reason, if the necessary documents are not available, the petitioner will have to obtain the requisite certificates from the Court of competent jurisdiction, upon the production of which, the respondents will take the necessary action. 8.

In view of the aforesaid observations and directions, the instant petition stands disposed of.
