O.M.P.(MISC.)(COMM.) 74/2020 1.

This is a petition under Section 29A (5) of the Arbitration and Conciliation Act, 1996 seeking extension of time for completion of the arbitral proceedings and rendering an award. 2.

Learned counsel for the petitioner submits that despite the sole Arbitrator entering reference on 11.08.2016, the diligent participation of the parties, and the extension of time to conclude arbitration on two separate occasions by this Court, the arbitration has not yet concluded. In the meanwhile, the mandate of the learned Arbitrator expired on 13.02.2020. He, therefore, prays that the time for completion of arbitration and rendering of an award be extended by another one year.

Issue notice. Learned counsel for the respondent accepts notice and does not oppose the petition.

Keeping in view the fact that much time and labour has already been invested in the proceedings, the time for completion of arbitration proceedings and rendering of an award is extended by a further period of one year w.e.f. 14.02.2020. The mandate of the learned Arbitrator is thus extended till 13.02.2021. 5.
