By way of present Petitions, the petitioner seeks to set aside the Summoning Orders dated 16.12.2021 and 09.12.2021 passed by the learned Metropolitan Magistrate in CC NI Act No. 5964/2021 and CC NI Act No. 5480/2021 respectively and to stay the proceedings of the same. 2.

of the petitions filed, however, because of the mediation talks were going on inter se the parties, the same could not be pursued and abandoned as such. Now, the mediation proceedings have failed, the present petitions have been filed challenging the Summoning Orders dated 16.12.2021 and 09.12.2021. 3.

Submissions heard.

Since, the Summoning Orders dated 16.12.2021 and 09.12.2021 were passed by the learned Metropolitan Magistrate, there is an alternate remedy that was available to the petitioner to file the revision before the learned Sessions Judge.

Therefore, looking at the delay and also the circumstances as stated above, the present petitions along with pending applications are hereby dismissed with liberty to the petitioner to approach the appropriate forum as per law.
