By way of the present application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, applicant seeks anticipatory bail in connection with FIR No. 284/2025 dated 25.07.2025, registered at Police Station Patel Nagar under Sections 318/316/336/340/61/3(5) of the Bharatiya Nyaya Sanhita, 2023 ["BNS"]. 2.

I have heard Ms. Kajal Sehrawat, learned counsel for the applicant, and Mr. Tarang Srivastava, learned Additional Public Prosecutor for the State. Although the complainant had notice of the present application and was represented on the earlier dates of hearing, he is unrepresented today. 3.

By order dated 02.04.2026, the applicant was granted interim protection from arrest in connection with the present FIR, subject to his joining the investigation as and when required by the Investigating Officer. The relevant observations made in the said order are extracted hereinbelow:

The FIR was registered at the instance of respondent No. 2 - complainant, making an allegation of cheating, fraud, and forgery, against co-accused Narender Singh. The complainant is a Business Correspondent of Airtel Payments Bank, and alleged that he had been cheated of Rs. 13,93,000/-, in a transaction with regard to the transfer of a gold loan balance, orchestrated by Narender Singh in collusion with the officials of Kotak Mahindra Bank and Airtel Payments Bank. The present applicant is the Territorial Sales Manager of Kotak Mahindra Bank.

Ms. Kajal Sehrawat, learned counsel for the applicant, submits that the applicant had earlier sought anticipatory bail before the learned Sessions Court, but the application was dismissed by order dated 18.03.2026. Ms. Sehrawat submits that even prior to the said order, the applicant had, in fact, joined investigation and provided all documents in his possession to the Investigating Officer ["IO"]. She further submits that the chargesheet has already been filed, including against the present applicant, and that co-accused Narender Singh has been released on bail, by order of the learned Sessions Court dated 21.02.2026.

Mr. Singh, on the other hand, submits that several notices have been issued to the applicant, particularly for supply of documents necessary for the proper investigation of the case, including a copy of the agreement between Kotak Mahindra Bank and Airtel Payments Bank, original documents of accused Narender Singh, and the original application filed by Narender Singh for transfer of the gold loan balance. It is accepted that the applicant did join investigation prior to the rejection of anticipatory bail by the order of the learned Sessions Court, and that the chargesheet has already been filed against the applicant, while a supplementary chargesheet is also expected at a later stage.

Mr. Singh further submits that the IO has sought the aforesaid documents both from applicant and from senior officials/Branch Manager of Kotak Mahindra Bank. 7.

Mr. Chakraborty submits that the aforesaid documents may also be sought from Airtel Payments Bank.

Having heard learned counsel for the parties, I am of the view that this is a fit case for grant of interim protection. The applicant had already joined investigation, and contends that the documents in his possession have already been given to the IO. While the IO disputes this position, it remains the case that he has sought the documents from senior officials of Kotak Mahindra Bank also. The applicant states that he has also written to his colleagues seeking the documents so that he may hand them over to the IO. case appears to be largely documentary in nature, the chargesheet has already been filed against the applicant without arrest, and the principal accused Narender Singh has been granted regular bail by the learned Sessions Court."

The aforesaid interim protection was continued vide order dated 13.05.2026, wherein the contention of Mr. Srivastava was recorded to the effect that two additional documents were required from the applicant. Accordingly, the applicant was directed to report to the Investigating Officer on 16.05.2026, and either furnish the said documents or categorically state that the same were not available with Kotak Mahindra Bank ["the Bank"], where the applicant is stated to be working as a Territory Sales Manager.

Pursuant thereto, Mr. Srivastava has handed over a status report dated 18.05.2026, which is taken on record. The said status report records that the applicant stated before the Investigating Officer that neither he nor the Bank was in possession of the original documents; however, certified scanned copies thereof have been furnished to the Investigating Officer by the Bank.

In view of the aforesaid, Mr. Srivastava, on instructions from the Investigating Officer, who is present in Court, submits that the applicant has duly joined investigation and has cooperated with Investigating Agency by furnishing the requisite documents for the purposes of investigation.

In view of the above, it is directed that in the event of the applicant's arrest in connection with FIR No. 284/2025 dated 25.07.2025, registered at Police Station Patel Nagar, under Sections 318/316/336/340/61/3(5) of the BNS, he shall be released on bail upon The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

furnishing a personal bond in the sum of Rs. 30,000/-, alongwith one surety in the like amount, to the satisfaction of the Investigating Officer["IO"]/Station House Officer ["SHO"], subject to the following conditions:

a) The applicant shall report to the IO on each and every occasion as and when required by the IO, and shall cooperate with the investigation and all related proceedings;

b) The applicant shall furnish his mobile number to the concerned IO/SHO and shall ensure that the said mobile phone remains operational and switched on at all times. The applicant shall neither change nor switch off the said mobile number without prior intimation to the concerned IO/SHO;

c) The applicant shall furnish his complete residential address to the concerned IO/SHO and shall not change the same without prior intimation to the concerned IO/SHO;

d) The applicant shall not, directly or indirectly, attempt to influence the complainant, tamper with the evidence, or otherwise indulge in any act or omission that may be unlawful or prejudicial to the proceedings.

e) The applicant shall further not offer any inducement, threat, or promise to any person acquainted with the facts and circumstances of the present case;

f) The applicant shall maintain good conduct and shall not commit any offence during the pendency of the present proceedings. 8.

The bail application, alongwith any pending applications, stand disposed in the above terms.
