Mr Kunal Malhotra and Mr Vivek Kumar Karan, Advocates.

versus STATE ..... Respondent Through:

Mr Shalya Agarwal, Mr Shivani Sharma, Advocates for Ms Richa Kapoor, ASC for State with SI Puran Singh, Ps Gokulpuri.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 18.02.2020 1.

The petitioner has filed the present petition, inter alia, praying that custody parole be granted to the petitioner to visit the Pakistan High Commission, Chanakyapuri, New Delhi.

2.

The petitioner claims that such a visit is necessary, as the petitioner is required to obtain recommendation as well as verification of his address in Pakistan. The petitioner is currently serving his sentence. He was convicted pursuant to FIR No.79/1994, under Sections 3/435 of the Terrorist and Disruptive Activities (Prevention) Act, 1987 registered with PS Gokulpuri. 3.

This Court is not persuaded to accept the petitioner's prayer for being released on custody parole, as it is apparent that the same is not necessary.

In the event, the petitioner seeks certain recommendations from officials of the Pakistan High Commission, he is at liberty to write to the Commission and it is not necessary that he personally visits the said Commission. Similarly, there is no requirement for the petitioner to be personally present at the Pakistan High Commission for verification of his local address in Pakistan.

4.

The petition is unmerited and is, accordingly, dismissed. VIBHU BAKHRU, J FEBRUARY 18, 2020 MK
