The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter "CrPC")] has been filed by the petitioner praying for quashing of FIR no. 676/2024 registered at Police Station Shahbad Dairy, for offences punishable under Sections 290/106(1) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter "BNS"). 2.

The brief facts are that on 17.09.2024, one Keshav, son of respondent nos. 2 and 3, died after suffering an electric shock while working at a construction site. The information was received at BSA Hospital, where Keshav was declared "brought dead." was electrocuted through a mixer machine being used at the site. Consequently, the police registered the case against the petitioner. 3.

It is submitted that the petitioner and respondents nos. 2 (father of the deceased) and 3 have now settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. 4.

It is submitted that the petitioner has made payments against the settlement amount and hence no dues are stated to be pending against the respondent no.2. Compromise deed dated 24.02.2025 is on record and has been annexed to the petition. Qua this, the respondents no. 2 and 3 have agreed to withdraw the case arising out of FIR No. 676/2024 registered at Police Station - Shahbad Dairy against the petitioner. 5.

Learned counsel appearing on behalf of the petitioner submitted that respondents no. 2 and 3 have settled all disputes for a sum of ₹ 3,00,000/-, out of which a remaining amount of ₹20,000/- was agreed to be paid at the time of quashing of the FIR.

At this juncture, petitioner has handed over the balance amount of ₹20,000/- to respondents no. 2 and 3 today in the Court. 7.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 8.

Learned APP for the State submits that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties. 9.

Heard learned counsel for the parties and perused the record. 10.

The petitioner is present before this Court and have been identified by their counsel and Investigating Officer, Police Station - Shahbad Dairy. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Respondents no. 2 and 3 are also present in the Court and have been identified by their counsel and the Investigating Officer. 11.

On a query made by this Court, respondents no. 2 and 3 have categorically stated that they have entered into compromise on their own free will and without any pressure. It is also stated that the entire dispute has been amicably settled between the parties and they do not wish to pursue the matter any further 12.

Keeping in view the fact that the matter stands amicably been settled between the petitioner and respondents no. 2 and 3 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 13.

It is, thus, in the interest of justice to quash the afore-mentioned FIR and the proceedings emanating therefrom.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR no. 676/2024 registered at Police Station Shahbad Dairy, for offences punishable under Sections 290/106(1) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter "BNS"), and consequent proceedings emanating therefrom, are quashed qua the present petitioner.

The petition along with pending application(s), if any, stands disposed of.
