O R D E R

% 14.03.2024 By way of the present petition filed under section 29A (4) & (5) of the Arbitration & Conciliation Act 1996, the petitioner seeks extension of the mandate of the learned Sole Arbitrator, who seized of their disputes with the respondent.

Ms. Rashmi Mehra, learned counsel appears on behalf of the respondent on advance copy; accepts notice and does not oppose the prayer made.

The record shows that the learned Sole Arbitrator was appointed vide order dated 10.01.2022 made in Arb. P. No. 576/2021 titled Amilionn Technologies Pvt Ltd vs. Telecommunication Consultants India Ltd. and the first procedural hearing was held on 22.02.2022. As recorded in order dated 21.07.2023 made by the learned Sole Arbitrator, the parties granted to the learned Sole Arbitrator a consensual extension for a period of 06 months with effect from 30.08.2023.

Vide e-mail dated 21.12.2023, the learned Sole Arbitrator has informed the parties that since his mandate ends in February 2024, some further time would be required for publication of the Award. 7.

The matter is stated to be at the stage of final arguments. 8.

Upon a conspectus of the averments contained in the petition and the submissions made, the petition is allowed; and the mandate of the learned Sole Arbitrator is extended, as prayed-for, for a period of 06 months with effect from 01.03.2024, with a request to the learned Sole Arbitrator to conclude the proceedings by that time. 9.

It is further observed that any arbitral proceedings conducted after the expiration of earlier mandate shall stand validated and regularized. 10.

The petition is disposed-of in the above terms. 11.
