Mr Fahim Ahmed Khan, learned counsel, who appears on behalf of the appellant, says that he has instructions to withdraw the appeal. 1.1 It is Mr Ahmed's submission that the appellant has arrived at a settlement with the respondent.

To be noted, on 14.03.2024, when the matter was listed before the Court, we had granted conditional stay on the operation of the impugned judgment, subject to deposit of the decretal amount by the appellant. 2.1 Concededly, the decretal amount has been deposited. 3.

However, in view of the aforementioned submission made by Mr Ahmed on behalf of the appellant, the appeal is dismissed as withdrawn. 4.

Pending application shall stand closed.
