O R D E R

The instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking the following reliefs: "(a) Issue a writ of mandamus directing Respondent No. 1 (Debt Recovery Appellate Tribunal) to expedite the proceedings in RA 50 of 2022 and RA 54 of 2022 and ensure their early disposal in a time-bound manner.

(b) Direct Respondent No. 1 to vacate its interim orders restricting access to the first and second floors of the school building, thereby allowing the Petitioner to resume normal operations.

(c) Direct Respondent No. 2 to refrain from undertaking any actions that are contrary to the rulings of the Debt Recovery Tribunal, Jaipur, dated 31/03/2022, and to ensure compliance with the said orders.

(d) Pass any other orders or directions as this Hon'ble Court may deem fit and proper in the interest of justice and equity." 2.

bearing RA No.50/2022 and RA No.54/2022 are pending before the learned Debt Recovery Appellate Tribunal (hereinafter "DRAT") since the year 2022 and that the petitioner being an aggrieved party, is not being heard by the learned DRAT which is grossly affecting his legal rights. 3.

After some length of arguments, learned counsel for the petitioner submitted that he may be permitted to file an application for early hearing before the learned DRAT and the learned DRAT may be directed to adjudicate the same and pass an appropriate order for disposal of the said appeals pending before it expeditiously in a time-bound manner. 4.

Learned counsel for the respondent No.2, appearing on advance notice, submitted that he has no objection to the innocuous prayer made for liberty to file early hearing application before the learned DRAT for expeditious disposal of the said appeals.

Taking into consideration the aforesaid facts and no objection of the learned counsel for the respondent No.2, the instant petition along with pending application is disposed of with liberty to the petitioner to move an application seeking early hearing of the appeals i.e., RA No.50/2022 and RA No.54/2022, pending before the learned DRAT within a week. It is further directed that the learned DRAT, after considering the grounds mentioned in the said application, shall pass an appropriate order for disposal of the said appeals pending before it in an expeditious manner, in accordance with law.
