The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950 read with Section 151 of Code of Civil Procedure, 1908 ('CPC') seeking directions to the learned Trial Court to dispose of the application filed by the petitioner/defendant no. 1 under Order VII Rule 11 of CPC on merit first as the same was filed in October, 2024 in CS NO. 1106/2018 but is still pending for adjudication. 4.

The learned Trial Court is proceeding with the matters in accordance with its own board after keeping in view the pendency and age of cases before it. In such circumstances, it would not be appropriate to issue any direction to the trial Court for expeditious disposal or to decide the matter in a time-bound manner.
Accordingly, the present petition is disposed of.
