versus STATE BANK OF INDIA ..... Respondent Through Mr. Rajiv Kapur, Mr. Akshit Kapur, Ms. Tanya Kapoor, Advs. alongwith Mr. Neelkanth Kapoor, Law Officer, SBI.

CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 06.02.2020 1.

Ms. Jain, who appears for the petitioner says that in the light of the circular dated 27.11.2019 issued by SBI the grievance of the petitioner qua circular dated 1.2.2019 stands redressed. 2.

According to Ms. Jain, the corollary of this step taken by SBI would be that it would have to refund excess monies received by it towards commission.

3.

The writ petition is, accordingly, closed as prayed. The petitioner will, however, have liberty to make a representation qua refund of commission.

4.

If a representation is made, SBI will consider it in the light of the circular dated 27.11.2019.

5.

I may only note that according to Mr. Kapur, who appears for SBI, a copy of the circular dated 27.11.2019 was filed with the Registry on 4.2.2020 via Diary No.157956. The said circular is, presently, not on record.

6.

However, a copy of the same was handed over to me in Court. 7.

The Registry will scan and upload the same for the purposes of good order and record.
