This writ petition has been filed on behalf of the Petitioner under Article 226 of the Constitution of India read with Section 482 Cr.P.C. seeking 2nd spell of furlough in case FIR No.240/2011 under Sections 302/482/34 IPC registered at PS: Palam Village. 4.

It is stated in the petition that Petitioner was convicted under Section 302/482/34 IPC by the learned Sessions Court on 18.07.2024 and sentenced to life imprisonment by order dated 19.08.2014. Crl.A. No.1650/2014 was dismissed by this Court on 20.02.2018. Petitioner had prayed for grant of 2nd spell of furlough for a period of two weeks on 17.01.2024 but no response has been received till date and to the best of his knowledge, the application is pending consideration. 5.

Learned Standing Counsel accepts notice on behalf of the State. 7.

Since the application for seeking furlough is pending consideration, the present petition is disposed of with a direction that the Competent Authority shall decide the application within a period of two weeks from today and communicate the decision to the Petitioner, who will be at liberty to take recourse to appropriate remedies in accordance with law in case of any surviving grievance.
