Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioners for quashing of FIR No.97/2023 under Section 420/120B/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Madhu Vihar, Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 01.06.2023.

On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

Learned counsel for the Petitioners, submits that the mediated Settlement has been duly acted upon and the Sale Deed duly stands executed in the name of the Respondent No. 2.

Learned counsel on behalf of the Ghaziabad Development Authority, confirms that the property stands mutated in the name of the Respondent No. 2, namely, Mr. Shiv Kumar Gupta and Ms. Preeti Gupta. 6.

Learned ASC for the State, submits that the IO tried to contact the Complainant but he was not responding.

On the Complaint of the Respondent No.2/Complainant, FIR No.97/2023 under Section 420/120B/34 of IPC, got registered at Police Station Madhu Vihar, Delhi.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 01.06.2023, before the Delhi Mediation Centre, Karkardoma Courts, Delhi. It is settled between the parties that the Applicants have agreed to execute the Sale Deed in respect of Plot No. 623 measuring 250 sq. mtrs. Situated at Neeti Khand-2, Indrapuram, Ghaziabad, in favour of the Complainant upon receiving a sum of Rs.2,00,00,000/- from him towards full and final settlement. The Sale Deed shall be executed by the Applicants on or before 05.06.2023. It is further agreed that the Complainant shall remain present at the Office of Sub-Registrar, Ghaziabad for execution of the Sale Deed on or before 05.06.2023, with necessary documents.

Today, the Respondent No. 2, who is present in the Court, states that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

he has no objection if the said FIR is quashed. 10.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 11.

Considering the nature of the allegations and that they have settled the matter, the FIR No.97/2023 under Section 420/120B/34 of IPC, registered at Police Station Madhu Vihar, Delhi and all the consequential proceedings emanating therefrom are quashed 12.

The Petition is disposed of accordingly. Pending Applications, if any, also stand disposed of.
